Terms of Service

1. Eligibility and Account Responsibility

You must be at least the age of majority in your jurisdiction or have consent from a parent or legal guardian to use the Service. When creating an account, you agree to provide accurate, complete information and to keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activities that take place under your account. Notify us immediately at admin@tcgvisor.com if you suspect unauthorised access or a security breach.

2. Acceptable Use and Account Rules

• Use the Service only for lawful purposes and in accordance with these Terms.
• Do not probe, scan, or test the vulnerability of the Service or bypass security measures.
• Do not share your account, resell access, or use automated tools to scrape or overload TCGVisor.
• Do not upload content that is illegal, infringing, defamatory, harassing, or harmful.
• Respect other users and refrain from attempting to access collections or data that do not belong to you.

We reserve the right to investigate and suspend accounts that violate these rules or create risk for the Service or other users.

3. Collections, Content, and Data

You retain ownership of the information you add to your collection. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, process, and otherwise use that content solely as necessary to operate, maintain, protect, and improve the Service. This licence does not permit us to commercially sell or sublicense your content outside TCGVisor without your permission. You are responsible for ensuring the content you submit is accurate, lawful, and does not infringe third-party rights. We describe how we process personal data in our Privacy Policy and explain cookie usage in our Cookie Policy.

4. Intellectual Property and Third-Party Rights

TCGVisor, including its design, code, and original content, is owned by TCGVisor. Pokémon and all related characters, item names, and imagery are trademarks of Nintendo, Creatures, GAME FREAK, and The Pokémon Company. TCGVisor is an independent fan project and is not affiliated with or endorsed by these entities. Using the Service does not grant you ownership of or rights in TCGVisor's trademarks, logos, or proprietary content.

5. No Financial Advice

TCGVisor provides organisational tools and informational features, such as price tracking or marketplace links, for your convenience. These features are not recommendations to buy, sell, or hold any card or asset. You remain solely responsible for your collecting and trading decisions, and you should conduct your own research before engaging in any transaction.

6. Plans, Payments, and Third-Party Data

Some features of the Service may require payment. Unless otherwise stated, fees are non-refundable and due at the time of purchase. You authorise us to charge the payment method you provide for applicable fees, and we may change prices with reasonable advance notice provided through the Service or by email. Refunds will be handled in accordance with applicable law. For example, if you are an EU consumer purchasing digital services, you may have a 14-day right of withdrawal unless you request immediate performance or otherwise waive that right. Pricing data, marketplace links, and other references to third-party services are provided for your convenience. We do not control or guarantee the accuracy of third-party information and are not responsible for transactions or disputes outside TCGVisor.

7. Disclaimers and Warranty

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant the accuracy, completeness, or availability of data supplied by third parties (including card prices and marketplace information). Your use of the Service is at your own risk, and you are responsible for ensuring that the Service meets your needs before relying on any information provided through it.

8. Limitation of Liability

To the fullest extent permitted by law, TCGVisor and its affiliates, directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill, resulting from your use of or inability to use the Service. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the amount paid by you, if any, during the twelve (12) months before the event giving rise to the claim.

9. Suspension and Termination

We may modify, suspend, or discontinue any feature or portion of the Service at any time, with or without notice. We may suspend or terminate your access for any reason, including if you violate these Terms, abuse the Service, or if we discontinue the Service. You may delete your account at any time through the Service (where available) or by contacting us. Upon termination, your right to access the Service ends immediately, but provisions that by their nature should survive (including intellectual property, warranty disclaimers, and limitations of liability) will remain in effect. We will delete or anonymise your personal data within a reasonable period after termination, except where we must retain information to comply with legal obligations, resolve disputes, or enforce our agreements.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the date at the top of this page or provide additional notice as required by law. Continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, you must stop using the Service.

11. Governing Law

These Terms are governed by the laws of Spain, without regard to conflict of law principles, and you agree to submit to the exclusive jurisdiction of the courts located in Spain, unless mandatory law provides you with different rights. If the laws of your country of residence require additional protections, those mandatory rights remain unaffected.

12. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. In such a case, the invalid provision will be replaced with a valid provision that most closely matches the intent of the original.

13. No Waiver

Our failure to enforce any provision of these Terms will not be considered a waiver of our right to enforce that provision or any other provision in the future.

14. Entire Agreement

These Terms, together with any additional agreements you sign with us that expressly supplement them, constitute the entire agreement between you and TCGVisor regarding the Service and supersede all prior understandings on that subject.
